TERMS OF SERVICE

These General Contract Conditions (hereinafter, General Conditions) regulate the purchase and sale process of the products offered by PerilSole in the catalog available on its website www.perilsole.com. The General Conditions bind Perilsole and the buyer (client), granting them a series of rights and obligations, from the moment the latter places and accepts an order through the aforementioned page. .

The client must provide the following information in order to place the order: name and surname or company name, delivery address, contact telephone number and contact email.

1. NAME AND COMPANY NAME

In compliance with Law 34/2002 on Services of the Information Society and Electronic Commerce (LSSICE), we inform you that the ownership of the domain of our virtual store, www.perilsole.es, corresponds to CENTRO OPTICO NERJA SL, Pintada 14, 29780 Nerja (Málaga), a company legally constituted in Spain with CIF B29741790 and registered in the Mercantile Registry of Malaga on 05/10/95, Volume 1723, Page MA-22.113, Page 37. 1st Entry (hereinafter perilsole.com ). 2. PURPOSE OF THE CONTRACT

The purchase and sale of the products offered by Per il Sole on its website by the client.

3. BID PROCESS

PerilSole's offer is limited to the products that appear on its website www.perilsole.com. The tab for each product indicates the retail price, including VAT. Shipping costs are not included in this price. The total cost of the order (sale price to the public of the product or products that comprise it plus the corresponding additional expenses) will be communicated to the customer at the time of placing the order and prior to its acceptance. The price of the products will be the one that appears on the website at the time of placing the order.

4. ACCEPTANCE OF THE OFFER

It occurs at the moment in which the client gives his express consent to the order placed, and after the acceptance of the General Conditions. It materializes when accepting these and finishing the purchase process.

5. PAYMENT OF ORDERS

There are 2 ways to pay the price established for each order, among which the customer can choose: 1. Payment by credit card: The customer can choose to pay by credit card, performing the operation at the time of placing the order. Only Visa and Mastercard cards protected by Verified Visa are accepted. If the customer's card is not registered by Verified, the customer must check with their bank or savings bank to be able to register it. 2. Payment via PayPal.

6. DELIVERY OF ORDERS

The delivery times of the orders depend on the availability of the product or products that compose them. However, this availability period may be modified in the event that simultaneous orders are produced for the same product or products that lead to the end of product stocks. The new delivery period will be indicated to the client in the shortest possible time. If the end of stock is final, the customer will be notified so that they can choose between choosing a different product, or canceling their order. The delivery will be made at the delivery address indicated in the order delivery details. The subsequent modification of this address may generate a series of expenses that would be borne by the client. Orders will be delivered by a transport company at the delivery address indicated by the customer and to the person who has been designated as the recipient of the order. These data will be recorded on the delivery note of the transport company. If at the time of delivery it is visible and clear, without the need to manipulate the shipping packaging or the product itself, that a product has defects caused by transport damage or it is appreciated, in the same way, a error in the merchandise received, the client must record it on the delivery note and notify PerilSole through the corresponding contact form within 24 hours of receipt of the order in order to request the return of the product or products affected and with this is the substitution for a new one or the reimbursement of the price paid for it. The client may request an invoice through the same contact form.

7. CANCELLATION OF ORDERS

The customer is recognized the right to withdraw from the order within fourteen business days from receipt of the order, as stated in Article 68 of Law 3/2014, of March 27. Outside this period, revocations of orders will not be accepted. When the customer has exercised the right of withdrawal or termination, Perilsole will be obliged to return the sums paid by the customer, less shipping costs. The refund of these sums will be made as soon as possible and, in any case, within a maximum period of thirty days from the withdrawal or resolution.

The Client must communicate the cancellation through the corresponding contact form in the section My account> View Order> Refund my Order,  or, contacting by E-mail at info@perilsole.com. In this way, the customer can be informed of the order return procedure (return number, shipping method and delivery address), as well as returning the items in question in their original packaging in perfect condition, without having used them and accompanied by the accessories. and documents provided (brochures, guarantees, certificates of authenticity, etc.), as well as the copy of the invoice attached to the delivered items. Once accepted, we'll refund you within 1-3 business days. For refunds we use the same payment method used for the original transaction. For international shipments, the return shipping costs will be borne by the customer.

8. OBLIGATIONS OF THE CUSTOMER

Read these General Conditions prior to accepting the order. Respect the General Conditions once the order is accepted. Pay the prices agreed at the time of placing the order. International buyers should note the following:

Import duties, taxes and charges are not included in the item price or shipping cost. These charges are the buyer's responsibility.

The client must find out in the customs office of his country what these additional costs are before bidding or buying.

9. OBLIGATIONS OF PERILSOLE

Deliver the product in good condition to the designated shipping location. Respect the price of the orders agreed at the time of their completion.

10. RIGHTS OF THE CLIENT

Receive the products that make up your order in perfect condition. Cancel the order before it is shipped using the contact form.

11. PERILSOLE RIGHTS

Receive payment for orders. Modify the prices established on your website for your products. Modify the delivery times of the product based on their availability. Cancel orders due to customer non-payment.

12. VALIDITY OF THE CLAUSES

Even if a clause of this contract or one of its parts is declared invalid or inapplicable, the rest of the clauses or its parts will continue to be valid and have value.

13 APPLICABLE REGULATIONS

These General Conditions are governed by current Spanish regulations, and specifically by: Civil Code, Law 26/84 of June 19 General for the Defense of Consumers and Users, Law 7/98 of April 13 of General Conditions of the Hiring, Law 7/96 of January 15 on Retail Trade Regulation, Directive 2000/31 EC of the European Parliament and of the Council of June 8, Law 34/2002 of July 11 on Services of the Information Society and Electronic Commerce, Law 23/2003 of July 10 on Guarantees in the Sale of Consumer Goods and the regulations that develop them. The parties, expressly waiving their own jurisdiction, accept the Spanish law as the governing law of this contract and submit to the courts and tribunals in Spain for the resolution of any disputes that may arise from it.
